Website Terms and Conditions

These Terms and Conditions ("Terms") govern your use of qawa.coffee (the "Website"), operated by Qawa ("we", "us", "our"). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. Scope of these Terms

These Terms cover your use of the Website only, including our "Request a quote" form. Any coffee cart booking you make with us will be governed by a separate written quote and booking agreement (our "Booking Terms"), which we will provide to you before you confirm a booking. If there is any conflict between these Terms and our Booking Terms, the Booking Terms apply to the booking.

3. Quote requests

3.1 Submitting the contact form is a request for us to contact you. It does not create a booking, reservation, or contract, and it does not oblige you or us to enter into any agreement.

3.2 Any prices, packages, menus, or availability shown on the Website are for general information only and are not a binding offer. A quote becomes binding only when we have sent it to you in writing and you have accepted it in accordance with our Booking Terms.

3.3 Quotes are valid for 14 days unless stated otherwise, and depend on the accuracy of the information you give us (such as event date, location, duration, and guest numbers).

3.4 You agree that the information you provide in the form is accurate and that you are entitled to share it. Please only submit your own contact details or those of someone who has agreed to be contacted.

4. Use of the Website

You agree not to:

  • use the Website in any way that is unlawful or fraudulent;

  • submit false, misleading, or spam requests through the contact form;

  • attempt to gain unauthorised access to the Website, its server, or any connected system;

  • introduce viruses, malware, or other harmful material; or

  • use automated tools to scrape or collect data from the Website.

We may block access or disregard submissions that breach these Terms.

5. Intellectual property

All content on the Website, including text, photographs, logos, graphics, and design, is owned by us or our licensors and is protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, or distribute any content without our prior written permission.

6. Accuracy of information

We try to keep the Website accurate and up to date, but we do not guarantee that all information is complete, current, or error-free. Menus, photos, and descriptions are illustrative, and actual products and setups may vary.

7. Availability of the Website

We provide the Website free of charge and on an "as available" basis. We may suspend, change, or withdraw all or part of the Website at any time without notice. We are not responsible if the Website is unavailable for any period, or if a form submission fails to reach us for technical reasons. If you do not hear from us within 5 business days, please contact us directly at hello@qawa.coffee. 

The Website may contain links to third-party websites (for example, social media). We have no control over these sites and are not responsible for their content or privacy practices.

9. Liability

9.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence, or for any other liability that cannot be excluded or limited under applicable law.

9.2 Nothing in these Terms affects your statutory rights as a consumer.

9.3 Subject to 9.1 and 9.2, and to the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Website or reliance on its content, including loss caused by viruses or technical faults that we could not reasonably have prevented.

10. Privacy

We handle personal data submitted through the Website in accordance with our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time you use it applies. Please check this page periodically.

12. Governing law and disputes

12.1 These Terms are governed by the laws of France. 

12.2 If you are a consumer living in the European Union, you also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country or in the courts of [COUNTRY].

12.3 If you have a complaint, please contact us first at hello@qawa.coffee so we can try to resolve it. 

13. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not waive that right.
